View Full Version : need an impartial opinion (damage)
well tonight i played some of this.

and i parked here, me parked behind my brothers green bm.
http://i51.photobucket.com/albums/f375/syeman/P110908_1810.jpg
this was a match arranged through work deluxe film lab's v technicolor film labs.
in the pic above there is a hut right at the edge of the pitch and the car park a couple of the lads from my work were having a knock about, and yes a ball bounced off my car denting the rear panel.

the chap came over and said sorry  to tell you the truth i don't remember alot for the next 10 minutes, but do rember him not offering to pay to fix it.
so after the match and with time to calm down i had a word and i explained fair dews if the ball had come from the middle of the green and hit the car that was down to me, but as he whacked the ball towards the car park form the edge of the pitch he should pay up.
he looked confused / worried and mumbled something about my insurance then said but im no good at cricket and it was an accident which i sympathised with and also felt sorry for him i also asked him if he thought i should pay for it he didn't look sure, but it was what it was you bent it you mend it so we left it there, hes going to think about it:eek: .
what i need to know is am i right on this matter and looking at where the dent is it might be double skinned will it knock out or is it a fill and respray:(
I have no idea and dont know how the ball hit you car amongst all the others but feel for you
Hope to help

Sound like you were almost too fair about it, i'd have definitely got his name, address and number anyway!! Probably not the smartest place to park but still dosent give people the right to dinge your car then walk away!! Id say if he paid half the cost and gave you 1 fair dig with the cricket bat at least! then next time take your bros BM, dosent look as tidy as your machine!!;)
Nasty enuf place for a dent too, doubt it would push out easy plus your car looks to be saphire black (as my old 330d)_ which means its metallic (just) and that means spraying right up the side!! Probably 150-300 quid i'd say so not too bad:(
Sorry to hear about this mate, but...
this was a match arranged through work deluxe film lab's v technicolor film labs.
you work at which one of these Labs? I deal with both of thse Labs all the time as I work in film production (I have Lab Pledgeholders agreements all over my desk at work) ...
It might be worth talkinig to a dent master, they normally do free quotes. Its really close to the edge but i'd imagine that part of the boot is easy to access. Can't harm for the cost of a phone call & it would save spraying which if you can ever avoid its best.
the chap that dinged the motor i work with and im quite new to the job, 3 months but i do think im in th right here.
im going to post on a cricket web page and see what they think.

even if they can't knock it out you can fill and spray it for a about £250 I reckon Sye.
Mark (black Sabbath) knows a good very good body shop, sure they could fix it up. But need to sort who's gonna pay for it :( It's no way your fault.

I would pursue him mate. He hit your car, he should pay for it. I hate people who dont give a crap about cars. they damage your car, then think its minor.

I`d say he should pay but then I wouldn`t park anywhere near a cricket ground, I guess this is why we have insurance `tho. I think if you remove your rear light it`ll give enough access to "pop" that back. We watched a guy at Gaydon and its quite amazing what they can do and how quickly its done.

i remember.. from when i used 2 play cricket... yes i was able to run back in the days... but if the ball damaged a house the club would pay for the costs... ur car is covered thru ur insurance i think but only if it was a direct result of what was goin on out in the middle...
basically ur work mate tosser.. has 2 cover the costs.. if not... smack him around a bit.. with a bat.. until he sees sense...
wat a nob... i would have chin;d him...

Mate bit sorry, but it's kind of like playing golf. You don't park your car where it can get hit by a ball either while playing, pacticing or fannying about. I would hazzard a guess there's a sign in the car park "Owners cars are parked at their own risk etc...."
If the guys wants to be decent, he'll pay up, If not, he won't. Personally, I would pay.
If he doesn't, well then it's up to you but I'd be getting my point across. Ask him what he would say if it were his car. If he's a dick about it, "accidentally" trip next to his car a lob a full can of Coke at the drivers door.
Anyway, serves you right for playing such a gay sport.

Not sure where you stand with this Sye tbh,but pm me if you need help with a bodyshop who can sort it for you,for reasonable money.Maybe best to get a quote to show knobhead  ,and then get it sorted for cash ;)
Like for like is a stupid idea if you work with the guy. Doing something to his car would quickly degenerate to the point you can't really work with these guys - especially as your new there.
HOWEVER you are 100% in the right. someone smacks into your car with a ball or anything else, how is that ever your fault?
I'd pursue the money back for definite..

The "Cars parked at owners own risk" sign would cover damage caused by the legitimate use of the facilities - IE the cricket game, a ball coming out of the nets, a branch falling from an overhear tree etc etc
It doesn't cover people titting about in the car park while they are not playing. Get some quotes, speak to him again. Prior to that, have a word with a solicitor with regards to the legal position.

I feel for you mate.
You could be on a sticky wicket here (sorry, no pun intended), no doubt the car park will be private property (like a supermarkets) so chances are he will just walk away saying was an "accident" and that you will have to use your insurance, the police or courts wont be interested (even a private case will be weak).
I doubt even one of them ambulance chasers off the TV will want to know either, as know one was hurt.
There probably is a sign somewhere that does say "cars parked at owners risk", it doesn't make it fair or right but there it is, the car was parked in a place where there is a possibility that it might get hit.
By all means try and get him to cough up, but don't hold your breath as you will be relying on his goodwill (there seems to be a world wide shortage), try and appeal to his better nature (like you have been) in a calm manner and you never know, a bonus point maybe that all his mates (and work colleagues) will think he's a stand up bloke.
If the paint hasn't cracked or the metals not creased then a good dent master (type) will be able to ease it out.
I hope you can get it all sorted out.

Dent him in the face with a cricket bat. Then say sorry. As long as you say sorry it will be fine.

yes he hit your car, but c'mon, why park there!!!!? was waiting to be hit...
i had Errol out at the weekend and he said he could get most of the dent out but i still wouldn't be happy, so i'm going to have to go down the fill and paint route:( .

how do you work that out, the playing green was miles away the best cricketer would have had trouble hitting it that far, unless like this chap he was standing at the edge of the car park:rolleyes: .

if its not on a crease or has not cracked the paint then a decent dentless repair guy should get it out with time a patience...its a similar place to mine (will see if i can dig out the pics) - It wont be 100% (as nothing is after a repair of any kind) but even if you have it sprayed and blended in - to a good trained eye, it will always show
ive had a top notch dent man look and he said he could get it out but he and myself wouldn't be happy and advised me to go down the repair route, which is fair enough he could have taken my money and run.
BMW think its going to cost around the £500/£600 mark but my mate said he could do it for £150 hes shit hot used to paint for ferrari in egham.
