View Full Version : Got pulled over for undertaking this morning!

Something to share - Was pottering along the A406 (North Circular) after Ikea at about 8 am, and there was this slow car in front of me doing 30ish on the fast lane!...what am I supposed to do? put my foot down and pull left and undertake, and then into the fast lane doing about 60.
Too late! Saw the blue lights behind me and thought shit! I had it! Pointed at me to pull over from behind.
Got out of the car, and walked over to him. "What does the highway code teaches about you about overtaking? Left or right?" Right, I said meekly - said sorry a few times, and then cheekly said usually I drive slowly (did not know why I said that). Right, he said..you drive slow in that car....and then he said move on and be careful next time....whew! what an officer! I could have kissed him! I already had 6 points...:)

Errr... sorry officer my finger slipped and I pressed the M button. I had to swerve to avoid the car. :rolleyes:

Yeah I got off with 3 points for doing 103mph down the A3 - it was a sunny day and the road was empty - I thought I was in deep poo - the police man commented on my driving telling me I kept my distance well, did not tail gate or prat about - he said was young and I had a nice car (350Z at the time when they just came out) and offered me an on the spot fine and 3 points. I was so shocked when he asked for my licence I passed him my bank card. Was well funny - what a top bloke.
1 year later I got pulled in the M3 at 5 in the morning for . . . . wait for it . . . . pulling away to quickly - I tried explaining that whilst I may have put the foot down a bit sharpish my wife was doubled up with server stomach cramps and I was returning from the out of ours doctors with some drugs for her. The bastards pissed me about for over 15 minutes when I was only 300 meters from the house, I begged them to follow me back and they could waste my entire day if they liked - they would not budge even when she phoned in tears to ask me where I was - so I abused the coppers, told them to arrest me as I was driving off weather they liked it or not and if they wanted to they could take me to court and we would argue it out there - see if the court thought they were being unfair at which point the gobby little tit told me not to do it again and let me go.
So for all the good ones there are as many bad ones but at least you have a fighting chance as the good ones do seem to be really good - shame they just cant school the bad ones.

Well talking about twats, there was this police officer who stopped my father for a rear light which wasn't working on his friends car. My father has any car insurance so he can drive anything.
Well the bastard asked for the number plate of the private car he uses, my father rang me to ask for the plate as he doesn't remember it, well then he charged my father with 3 points for using a hand held mobile OUTSIDE the car (without stating he used it outside the car).
Well there was 2 off them and my father alone, so it is obvious they will take their words over my fathers but he still requested a court hearing.
Oh yeh and this was like a week ago !

It's not illegal to undertake, the Highway Code says that it should only be done when it is necessary (am I wrong?)..if the idiots stayed out of lanes 2 & 3 doing snail mph (God please..) then you wouldn't have to undertake..so who should the cop be pulling over eh?

There is no offence of passing on the nearside. In other words you cannot be prosecuted for doing so. It can be adduced as evidence of another offence, i.e. careless driving, but there must be circumstances of the manoeuver which makes the overtake careless.
The thing is, of course, that one can be taken to court for an overtake on the offside if there are circumstances which make the overtake careless.
Or to put it another way, it is advisable to ensure that when you overtake on the nearside you take steps to ensure that there are no elements of careless driving.
It is a common fallacy that the highway code makes law. My experiences as a process inspector proved that often police officers are similarly confused but it does not. It can be used as supporting evidence but there is no offence of overtaking on the nearside per se nor can the CPS adduce evidence of overtaking on the nearside on its own to prove any offence.
With regards to the case you mentioned: don't put any faith in these stories unless you can find the stated case to support it. Often magistrates courts have their own little fads and beliefs. In my force area we had certain courts which took urinating in the street as de facto evidence of disorderly behaviour. It took one chap who felt he was hard done by to challenge it and the courts had to abide by the laws of evidence again.

Slow drivers in the fast lane piss me off SOOOOOOOOOOOO MUCHHHHHHHHHHHHHHHHHHHHHHHHHHH here in Malaysia. Idiots doing 30km/h (not even mph) in the fast lane. You can flash at them to move over or whatever, and they act as if they dont know and just stay there forever
Then they get angry when u undertake them :confused:

They've changed it to a 3 points + £60 offence now, unless your "in traffic" or words to the effect in which case you can. So its nice and clear then.
