And to top it off the witness appeared to be totally on her side, as did the policeman, who said there's a possibility I might get prosecuted for driving without due care, so have got to look forward to that dropping onto my doormat - any ideas how long it might take?

What they both seem top failed to notice is that I was already on the roundabout, doing about 15mph, and she hit me on the rear passenger side of the boot.

Have only got a crappy phone pic so won't bother posting it as it's too depressing.

And my excess is £500...

She did destroy her 1989 Mazda 323 on my bumper though.

If I do get the prosecution, does it mean a trip to court? Don't really fancy that much.

as others have said - if you get hit from behind, its almost always the other persons fault - end of.

I had same kinda problem last summer. Got smashed into on a roundabout whilst I WAS DRIVING AROUND IT, my right of way etc etc...It got contested againt, other side finally caved in when i said id go to court and no settle for 50/50 -

Sounds as if the copper/witness took sides against you cause u drive a fast car and you're under 40...As others have said, in most cases, if someone hits you from the back then you have a very strong case. you can literally reverse into someone at a r/about entry point and still claim somone drove into you:) I once had a serious head-on smash when someone coming towards me turned to his right. To cut a long story short, he lost and I won but he then tried to sue me for 'Loss of confidence on the road...1500 quid'. WTF??? Basically I protested about the notion of 'right of way' and the insurers agreed. Hope you sort this out quickly.

If you think you are in the right, then fight your corner, justic usually prevails. I dont understand how if someone hits you from behind, on a round about, that you can be in the wrong. Unless you cut her up without indicating.

Not long ago my mum was with my aunt in a car park waiting for a space someone was leaving. Someone reversed out of a space behind them into my aunt's car, got out and had the cheek to say "I didn't do that". Upon closer examination paint from her car was found on my aunt's bumper, but she still insisted "that was me".

Some people are unbelievable, as Stock323 said, the copper is probably siding against you for the hell of it. If you think we were right then there is no reason why you should put up with it. If you win, could you claim against her for attempting to pervert the course of justice? Would be funny if you could and funnier if you did. :p

If you were already on the roundabout at 15mph and she hit you on the passenger side... somebody must have cut somebody up for you to be hit on that side.....

Being devils advocate - a due care & attention offence can carry anything from 6 points upwards... and would involve a trip to the court....

If you are a member of the AA - then get onto AA Legal Services as well the legal protection provided by your insurance company.

That's horseshit dude, sorry to hear that. If it helps, I got wiped off my bike about 5 years ago by some dork who came onto the roundabout and just sideswiped me. There was a copper behind him who took him to town (then did me for a rear tyre that was too low on tread, the bastid :( ), but he said it was an automatic win for me cos I was on the roundabout first and had automatic right of way, and the car had hit me from the rear quarter so was additionally presumed to be at fault anyway. And I won big too. I can't see that changing much since then, so I'd say screw what they said at the scene, like Yagga said get onto your insurance company and take the idiot for every penny. Take the offensive, you're in the right, don't wait to see what they're gonna do mate, get on the front foot and nail them hard.
