View Full Version : Cars been smacked up the rear!!!

So I'm on the M25 between junctions 29 and 30 going anti clockwise and in the other carriageway there is what looks to be a serious accident so the idiot rubber neckers on our side start to look and slow down. I had a bad feeling that something was about to happen and was yelling (for all the good it would do!!) at the car in fron to carry on. The next thing I know is that there is a screech of tyres and massive bang and my car lurches forward. some utter mindless, scum idiot has rammed his utter skank sierra into the back of my car :evil: . After firing off almost every verbal abuse I could think of he pulled onto the hard shoulder so we could inspect the damage. His car is a bit of a mess but mine really took the hit well. Still looks a mess and I don't know what it will look like underneath the bumper :( . His exact words were "sorry mate, I only took my eyes off the road for one second!!!!" I could have laid him out there and then if it wasn't for the copper approaching. His tax was out in june so hopefully he will done for that and it was questionable whether he had valid insurance but it would appear that he has, through kwik fit of all places :( .
Rang up my insurance and didn't give them any details but just asked that if i were to make a claim because I was hit from behind on the motorway and it is 110% the other drivers fault then will my premium go up and the response was "to be honest sir it is very likely" :( :( :( .
I am now going to get an estimate for the damage and see how much it totals but if I am very honest, I really am a bit too scared to make a claim at the moment :( :( as it will probably cost me more than the total damage will over the course of having to declare the claim over the next four or so years :( .

I know it doesn't look much but it took an almighty hit. Luckily the diffuser isn't too damaged ;) . The bumper is pushed in slightly but the boot opens perfectly and there doesn't 'seem' to be any further damage!!

I was expecting the damage to be more but luckily it doesnt look major!
Im sure that the bumper may be repairable mate. Sorry to hear whats happend, hopefully it gets sorted ASAP.
You have recently splashed out on that new diffuser aswell, now it looks batterd :mad:

The diffuser will repair Juber, it isnt so bad. I will get it pro painted as well when the bumper is done, probably out of my own pocket as i really am too scared to make a claim at the moment - just when i can't bloody afford it :( .
Can't believe my policy will well go up due to this arse hitting me. Could have probably coped with a prmium hike on the 330 but on the M3 they will screw my balls to the floor. IT WASN'T MY BLOODY FAULT!!!!
Ok, got that off me chest, sorry for the rant guys, just a little emotional right now :( .

Im suprised you are telling them....when my neighbour reversed into my 330 and smacked the wing, I just got her details and dealt with her insurance company direct. Never even mentioned mine and they were fine.
I have never got the 'report every incident unless you make a claim' mentallity of insurers. If I want to reverse through my garage door every bloody day thats completely up to me, as long as I don't claim - it does not affect their risk profile of me in regards to making a claim. Its frankly none of their god damn business. Its a condition of the policy though so I guess you have to, thankfully I have not had to ever use my insurance yet

I kind of rung anonymously. So far my insurer doesn't know it was 'me', it was just some one asking for advice. They never asked for a name or car reg, in fact no personal details were passed to them. The pratt is insured with Kwik Fit (all confirmed by the policeman at the scene) so I may call them direct. Just so much hassle. Thoroughly fed up.
I must admit though, i am suprised nobody has come out with the famous saying 'that will polish out :p ' as it might, well, apart from the dents in the bumper :( .
i am thankful that A) the damage is not worse, I thought it would be stoved in, B) my kids weren't in the car as I think i might have flipped out and C) I don't seem to have too much wrong, well, no worse than normal - and it got me off work early :p.

Get a quote, get in touch with the guy, ask him if he wants to pay for it out of his own pocket, if he says no, then say that you will go to his insurance and sort it out that way. This way if he says yes, its solved if he says no you go to the insurance company and try to see if they will sort it, which they should but it will affect his premiums.

Very sorry to read of this mate – by tomorrow you will have calmed down and you will asses the damage and realise it’s not too bad and it could have been a lot worse!
Don’t worry about your premium going up – Speak with the Albany Legal department [within your insurance] and explain the situation, they will cater to this chav and his clap-trap. Just get these details and pass to Albany and explain that it was his entire fault – he has admitted to the accident, tell them this – the copper report reference as well and if any other independent witness was there who saw the accident can also back you up.
You may wish to consider filling a Traffic Incident report – papers obtainable at your local nick – fill it in and also draw the diagram sketching the accident and the name of the copper on duty at the time – then insist on a courtesy car in the mean while.
I had an accident where a lady swerved in my lane – Albany took care of it and they had my driving a new 05 plate 525i M sport while mine was repaired – my no claims was intact and her insurances bared all expense and liability.. Bumpers are designed to take a hit – unlikely the carbon fibre reinforced bar is damaged, but if it is, easily replaced

And so on, scare him as if its going to cost loads. That way if its all good, both you & him will benifit in a quicker response & no hike in premiums.

You did well not to mention your name / car reg. The moment you do, it is recorded as an "incident" - not sure if this affects your premium or not (my insurers said it wouldnt), but you do have to declare it and it is on your year end NCB letter too.
It's a cheek to hit you with increased premiums if it's not even your fault. Bloody insurers always find some way of getting money out of you no matter what !

Thing is the money it will cost to do the M3 will probably be more than his Sierra is worth, so I doubt he will want to pay cash. Worth asking him though.

Judgemental? Perhaps... A chav in my opinion shows little regard to those on the road. From said circumstances, he falls firmly in said category. He is directly responsible for causing harm to others simply because he was (since we’re quoting) “rubbing necking”. Rest assured, though; I'm sure Paul will convey your condolences to him through the settlement :rolleyes:

Guys, thankyou so so so so much for the advice. This is why forums are so bloomin brilliant.
Here is what i will be doing tomorrow, I will be contacting the numptys insurance company Kwik Fit to start claims proceedings for my car to look mint again, I will also be informing my insurers of the accident but WILL NOT be claiming through them, only Kwik Fit.
I have been thinking long and hard about this and the front bumper has a few chips so will get that sorted whilst the car is in and they have the paint mixed, plus I will prepare the diffuser (not OEM) as there is a few knocks but nothing bad and get that sprayed to match again as well. Will also be giving them the grill surrounds and fog light surrounds to again do in OEM paint rather than rattle cans.

Don't get me wrong, rubber necking has to be one of my top 3 biggest hates on the road - traffic queues caussed by nothing with people blatantly looking at an accident, it drives me up the wall and I am usually the first to, er, express my displeasure!

Call me stupid but you claim on HIS insurance, it's his fault, his claim and his premiums that will go up. You are, in effect, the third party in the incident and theres no way your premiums can go up. Claim off his.

i too was in a no-fault accident before, but in my case, we both had to claim first, then claim back excess and compensation after the other party accepted the fault. I think Bimmerboy888 was in the same position recently.

Just hope he doesn't do a runner. The woman who slammed into my 330 3 years ago until today hasn't been located, although the insurance company had all the 'correct' details. Apparently, she has left the country :mad: So in the end, everything came out of my own pocket :mad:

it worrys the hell out of me everyday driving country roads that someone will do that to me, but you have to look on the bright side your ok and it is fixable albeit it major ball ache.
I had a lucky escape last month i hit my gate coming into my house luckily the gate shedded its paint and it all polished off the bumper its heart breaking

Insurance companies can be long, even with 110% non fault claims. There is a standard industry 90 days in which the 3rd party's insurer have time to respond. As mitsu mentioned, the premium can be hiked up until the settlement is confirmed, which unfortunately means having to come out of your pocket first:(

I agree that the back doesn't look too bad in the pics (thank god!) but i know the hassle of fixing it up, but glad to see you're making the best of a bad situation as always mate, so good on you for that :)
i am with direct line (;)) and suffered a couple of no-fault claims, and never had an increased premium cos of it, and they also guarantee not to increase premiums if you're hit by an uninsured driver.
How the hell did the other driver not see the big yellow bird in front of him i don't know!! :D

Sincere thanks guys. I have found out that my excess is not what I thought it was :mad: . I have a voluntary £250 excess and a further £500 compulsory excess that I didn't know about because of the type of car it is :mad: :mad: :mad: :mad: . I want it repaired only when the claim is settled in my favour so I think I will be dealing with his insurance company direct and not involving direct line. Even though I live in Kent I am taking the car later on this morning to fairfield BMW in essex as my dads company does a huge amount of business with themand they have their own onsite bodyshop that is highly thought of.
Just want this mess sorted :( .

Crazy thing was, about 45 minutes after the accident I am driving home down the other carrigeway in the tailbacks caused by the accident that the rubber necking fool was checking out when my wife calls and asks if I am okay. Turns out one of her friends husbands was in this carrigeway and saw a bright yellow M3 on the hard shoulder on the opposite side and realised it was me and made contact with his wife who in turn called mine. Guess the car gets noticed :p .

An update. Have been to an official BMW bodyshop and they have said I need a new bumper skin, carbon fibre bumper carrier (no bumper shocks on M3s) and a new diffuser. They are going to try and get an OEM CSL diffuser on the car as well :D .
I have made contact with the numptys insurance company and suprise suprise he hasn't informed them of the accident!!!! I now have a claim number and they will be making contact with said numpty today to establish what is going on.
I have also let my insurance company know what is going on and they have said that there is no problem with me dealing direct with his company to get the payout and hence not involving my insurance either directly or financially. My company have already said that they have waived my huge excess as they are so confident that I am in no way at all at fault which is a relief 'should' I claim via my insurance first.
BMW will be getting me a loan car for the duration of the repairs (5 days) and it will be...................................ANOTHER M3!!!!!
So, hopefully in four weeks my car will be going in for repairs.
However, there is no record that his car is insured as his old car is listed as insured not this sierra, but the police assured me it will be covered as there are details of it on the kwik fi insurance notes - he is actually insured with provident. My insurers direct line have assured me that if needed they will go all out for recovery of ALL expenses even the two car seats that are in my car as they might need replacement :shock: .
The bottom line is I won't be letting repairs commence until it is 100% confirmed that the claim is in my favour and it is 100% not my fault (which we all know it isn't).
Thankyou to everyone who has offered superb advice and good wishes, they are all sincerely appreciated :D . More to come soon I'm sure.

Normal diffuser is £55 +vat and the CSL is £550 +vat, however, obviously they won't provide me with one as my car isn't a CSL, I offered to provide any one of four numbers :p but they won't budge :( . But, what they did say is that if I repair the damaged CSL rep diffuser (easy), fill it and basically just get a base primer down and mask off the carbon then they will spray it for free as well as spray the grill surrounds and fog surrounds gratis as well so instead of rattle can finish it will be OEM finish :D . They will be putting on a new OEM M3 diffuser so I will be selling my old OEM diffuser on fleabay for a few bucks back. Total cost with normal diffuser is £1500. Lucky I ain't paying!!

No mate, will only get it when my car goes in. I am getting a call tomorrow to arrange what one it will be. I fancy a vert for a few days as I would never actually want to own one myself but for a few days jolly what the hell. Rest assured though, it will be the fastest M3 in the UK for five days :p !!

His insurance company want to send an engineer to look at the car!! In my eyes that is an admission of guilt and that the payout is in my favour without actually stating that the fault lies with their client.
On another note, I have two kiddie seats in the back of the car and my insurance company direct line have suggested I claim for the replacement of them due to them being secured in the car and being exposed to a forceful movement. My kids were not in the car and hence seats at the time though so there was no additional weight - anyone heard of this?
